These Terms and Conditions (the "Agreement") constitute a legally binding contract between you (the "Client") and Adaptive Aging Solutions, LLC, a Texas registered limited liability company ("Company," "we," "us," or "our"), regarding your access to and use of our website, services, and digital products. By accessing our website or purchasing any service or product, you confirm that you have read, understood, and agree to be bound by this Agreement in its entirety. If you do not agree, do not use our services.
1. Nature of Services — Educational Purpose
All services, consultations, digital products, and resources provided by Adaptive Aging Solutions, LLC are strictly educational and informational in nature. Nothing provided by the Company constitutes occupational therapy, physical therapy, medical advice, clinical assessment, diagnosis, or treatment of any kind. No client-therapist or client-provider relationship of a clinical or therapeutic nature is established through use of our services.
Recommendations and information shared during consultations or through our digital products are intended as general educational guidance only and are not tailored to any individual's specific medical condition, physical limitation, or clinical need. Clients are strongly encouraged to consult with their licensed physician, occupational therapist, physical therapist, or other qualified healthcare professional before implementing any home modifications, adaptive strategies, or recommendations discussed through our services.
2. Eligibility
Our services are available to legal adults only. By accessing our website, booking a session, or purchasing any product, you confirm that you are at least 18 years of age. The Company reserves the right to refuse service to anyone who does not meet this requirement.
3. Session Delivery
The Home Safety Strategy Session and Home Safety Follow-Up Session are delivered via video call only. Sessions are not recorded by Adaptive Aging Solutions, LLC. Clients are responsible for ensuring they have access to a compatible device, a stable internet connection, and a private environment for their session. The Company is not responsible for client-side technical difficulties. Please refer to our Refund and Cancellation Policy for details regarding technical issues on the client side.
4. Geographic Availability
Our educational consultation services are offered virtually to clients located in the United States. It is the client's sole responsibility to confirm that accessing educational consulting services is permitted under applicable laws in their state or jurisdiction. Services are not available where prohibited by law.
5. Limitation of Liability
To the fullest extent permitted by applicable law, Adaptive Aging Solutions, LLC, its owner, officers, employees, and representatives shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages arising out of or related to your use of our services or digital products, including but not limited to personal injury, property damage, loss of data, or financial loss resulting from the implementation of any information or recommendations provided.
Clients acknowledge that participation in any consultation and implementation of any guidance discussed is entirely voluntary and undertaken at their own discretion and risk. The Company's total liability to any client for any claim arising under this Agreement shall not exceed the amount paid by that client for the specific service giving rise to the claim.
6. Refund and Cancellation Policy
All bookings and purchases are subject to the Adaptive Aging Solutions, LLC Refund and Cancellation Policy, which is incorporated into this Agreement by reference and available in full at adaptiveaging.solutions (click link). By completing a booking or purchase, you confirm that you have read and agree to the Refund and Cancellation Policy in its entirety.
Digital products — including all downloadable guides, toolkits, and eBooks — are non-refundable upon purchase.
7. Dispute Resolution
In the event of any dispute, claim, or controversy arising out of or relating to this Agreement or the services provided by Adaptive Aging Solutions, LLC, the parties agree to first attempt resolution through good-faith negotiation. If negotiation does not resolve the dispute within 30 days, the parties agree to submit the matter to non-binding mediation before a mutually agreed-upon mediator in the State of Texas prior to initiating any litigation.
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any legal proceedings not resolved through mediation shall be brought exclusively in the state or federal courts located in Texas, and both parties consent to the jurisdiction of such courts.
8. Intellectual Property
All content created and provided by Adaptive Aging Solutions, LLC — including but not limited to digital guides, toolkits, eBooks, consultation materials, website content, and educational resources — is the sole intellectual property of Adaptive Aging Solutions, LLC and is protected by applicable copyright law. Unauthorized reproduction, redistribution, resale, or commercial use of any materials is strictly prohibited without prior written consent from the Company.
Digital products are licensed for personal, non-commercial use by the purchasing client only.
9. Affiliate Disclosure
Adaptive Aging Solutions, LLC participates in affiliate marketing programs, including the Amazon Associates Program. When you click on an affiliate link on our website and make a qualifying purchase, we may earn a small commission at no additional cost to you. Affiliate relationships do not influence our educational content or recommendations. A full Affiliate Disclosure is maintained as a standalone page on our website in accordance with FTC requirements.
10. Modification of Terms
Adaptive Aging Solutions, LLC reserves the right to modify or update this Agreement at any time. The effective date at the top of this page will reflect the most recent revision. 11. Severability
If any provision of this Agreement is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and all remaining provisions shall continue in full force and effect.
12. Entire Agreement
This Agreement, together with the Refund and Cancellation Policy and Service Disclaimer, constitutes the entire agreement between you and Adaptive Aging Solutions, LLC with respect to your use of our services and supersedes all prior communications, representations, or agreements on the same subject.
